It doesn’t really matter if you have been married for a month, a year or a lifetime, once you (or your spouse) have filed for divorce, there is nothing much you can do, but go along with the flow -even if the flow staggers along. According to California law, a couple must wait a full six months before they can finalize their divorce. This is the minimum time; some will go on for a much longer time. Until then, they will find themselves navigating all kinds of legal processes, none of which are either pleasant or simple, unless, of course, you know the right attorney in California. Dan Pocklington for instance, has become extremely popular for speeding up divorces, even the ones that seemed to go on forever.
Speeding up a Divorce
Expertise has endowed some family lawyers, like Dan Pocklington for instance, with well-researched tools that will help couples get divorced much sooner. Only highly knowledgeable and extremely experienced attorneys are able to appeal to certain legal loopholes that, if used properly, can be of much help to a couple who want to go on their separate ways.
Some of the resources available in the state of California include the following:
Motion for Bifurcation: By means of this legal resource, a court may determine that a marriage has been terminated and that each person is restored to their original single status. This resource may be used in cases in which there is no agreement on community property, for example. In this case, the battle over property will go on separately, after the couple has been granted the divorce. A family lawyer may request this if their client is remarrying, for example, or for taxing purposes. However, it should be noted that some divorces may not be accelerated even when this motion is presented and must wait at least for the full six months to go by.
Family Code Section 271: There are many reasons that delay a process of divorce longer than necessary. While the most frequent involve solving issue, such as alimony or property division, in some other cases, it could be your spouse’s lawyer who may be actually delaying the process. How is this done? Sometimes attorneys give their clients fake expectations regarding child custody or spouse support. On occasions, clients get ill-advise from their lawyers and end up messing up decisions that could have been made in total agreement. Sometimes, greedy lawyers do so, just to charge more money for the divorce and in the process, prevent their clients from getting what would be to their best interest. An experienced attorney can turn to this powerful statute to diffuse the tension and speed up things. This statute allows you to seek attorney fees against your spouse, even if you don’t really need to. This means that according to Family Code section 271, it is not important to know whether you can pay or not, what matters is that unreasonable behavior should be punished economically.
