Sometimes lost in a dispute over custody rights are entitled children. While parents can fight freely forward and backward on the rights of custody, the child is not always given the opportunity to express their opinion. The judicial system began to realize this in the mid-eighties and since then has implemented various measures to ensure protection of the child's wishes are considered.
Wisconsin Supreme Court created a list of guidelines for the consideration of custody of children. This resource was later accepted and confirmed within each state judicial systems. Here is a summary of the rights provided to children
-A child has the right to continue their relationship with each parent and receive care, guidance and support each as needed.
-The child has the right to maintain regular contact with a parent without custody, as well as a detailed explanation of the changes or cancellations in visiting hours.
-A child has the right to their ideas, feelings and opinions considered in all discussions about his welfare. This means that it should be treated as a bargaining chip in any element or aspect of the divorce settlement.
-A child has the right to freely express their love, friendship, or worship each parent. Should never feel ashamed or afraid to share these feelings about the other parent. Every parent has an obligation to respect the love and emotion that shows the child to the other parent.
-The child is entitled to an explanation of the reason for the divorce, and security was not their fault fault. Neither should be a source of guilt or any argument that arises between the parents.
-A child was never hurt influenced by a parent in order to manipulate the view of the child's other parent. This includes lying about the activities of the other parent or the child forced to make decisions that are designed to adversely affect the relationship with the other parent of the child.
This is a sample of child custody rights upheld by the courts of custody throughout the country. In addition to these rights, the court also takes into account the situations of life offered by both parents in awarding custody. Judges may also use interviews and sessions independent researchers to determine the preference of the child custody rights and the frequency of visits.
Is important to recognize that children have a voice in custody. Unfortunately, these rights are not always explained to the children or parents are distorted by vindictive. The judicial system has come a long way in recent years to protect the rights of child custody, but the continued support of parents and family members is always preferred.
